Communication Consent Agreement

This Communication Consent Agreement ("Agreement") describes how communications work when you use Bitta.ai ("Bitta," "we," "us," or "our"), an AI agent-presenter software-as-a-service. You upload content so we can create AI agents that present to viewers via text and voice and may send follow-up emails on your behalf. By creating an account or continuing to use the Service, you agree to this Agreement.

This Agreement is part of our Terms of Service and should be read alongside our Privacy Policy.


1. Scope

This Agreement covers:

  • (a) Bitta-to-you communications. Messages we send to you, such as account notifications and system alerts; and
  • (b) Agent-to-viewer communications. Follow-up emails sent on your behalf from or in connection with your AI agent to viewers who have interacted with it.

2. Bitta-to-User Communications

By creating an account, you consent to receive:

  • SMS messages containing verification codes, where you provide a mobile number;
  • Account alerts and system notifications necessary to operate the Service;
  • Service updates and maintenance notices that affect availability or security.

We will not send you promotional marketing communications without your separate consent, except as permitted by law.


3. Agent-to-Viewer Communications

Your AI agent may send follow-up emails to viewers who interact with it. You confirm and agree that:

  • Viewers have engaged with your agent voluntarily and in a manner consistent with applicable consent requirements;
  • Follow-up emails reference the actual conversation or interaction where appropriate and are not misleading as to their origin or purpose;
  • All such emails include a clear unsubscribe or opt-out mechanism;
  • You will honor opt-out and unsubscribe requests without undue delay;
  • You will not use the follow-up feature for unsolicited outreach, purchased lists, or contacts who have not meaningfully interacted with your agent.

4. Consent Requirements

For follow-up emails, consent is established when a viewer voluntarily engages with your agent in accordance with this Agreement and applicable law. You must not manually add email contacts who have not interacted with your agent through the Service in a way that supports lawful follow-up. Purchased, rented, scraped, or harvested email lists are strictly prohibited for use with the Service.


5. Opt-Out Methods

  • SMS from Bitta: Reply STOP to opt out of non-transactional SMS where supported by your carrier and our messaging provider.
  • Email from Bitta: Use the unsubscribe link or instructions included in the message.
  • Follow-up emails from your agent: Each email should include an unsubscribe link or equivalent mechanism. You must honor all opt-outs across channels promptly.

6. Message Frequency & Fees

The frequency of SMS messages from Bitta depends on your account activity (for example, logins and security events). Message and data rates may apply according to your mobile carrier's plan. Carriers are not liable for delayed or undelivered messages.


7. Record Keeping

Bitta maintains records reasonably necessary to operate the Service, which may include opt-in timestamps and related records, opt-out and unsubscribe logs, and delivery and engagement logs, subject to our Privacy Policy and retention practices. You should maintain your own records of consent, preferences, and compliance documentation as required for your business and regulatory obligations.


8. Changes

Bitta may update this Agreement from time to time. We will post the revised version and update the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Agreement, except where stricter notice or consent is required by law.
